Terms of service

These terms govern your use of Send by QuikSync (“Send”), provided by QuikSync Technologies LLP (“QuikSync”, “we”). By creating an account or using Send you agree to them on behalf of yourself and the organisation you represent (“you”).

1. The service

Send lets you send email campaigns from mailboxes and domains you control, with controlled sending (daily limits, batches, delays and sending windows), scheduling, suppression and campaign analytics. Messages are sent through your own mailbox provider or, where enabled for your workspace, a sending service operated by QuikSync.

Send does not and cannot guarantee that any message is delivered or reaches an inbox. Delivery depends on your domain reputation and authentication, recipient engagement, content, bounce and complaint rates, and the policies of receiving providers, none of which we control.

2. Accounts

  • You must give accurate information, keep your password confidential, and tell us promptly at support@quiksync.com if you suspect unauthorised access.
  • Workspace administrators control who has access to the workspace and are responsible for their users' conduct.
  • You may send only from domains and mailboxes you are authorised to use.

3. Acceptable use

You must follow the acceptable-use policy and the laws that apply to your messages and recipients, including anti-spam and data-protection laws. You must not use Send to circumvent the safeguards of email providers or receiving networks. We may pause campaigns or suspend a workspace that breaks these rules, shows high bounce or complaint rates, or puts the service or other customers at risk.

4. Your data

You own the content and recipient data you upload (“Customer Data”). You grant us the rights needed to host and process it to provide Send. You are the controller of personal data in Customer Data and we process it on your instructions, as described in the privacy policy. You confirm you have a lawful basis to send to every recipient you upload.

5. Plans, fees and billing

  • Plans, prices and limits are shown on the pricing page and in your workspace. Prices are in US dollars, billed in advance monthly or annually; applicable taxes are added where required.
  • Plan limits (mailboxes, users, active campaigns, emails per campaign per day, recipients per campaign) are enforced by the service.
  • Renewals, upgrades, downgrades, cancellation and refunds work as set out in billing and cancellation.
  • If a renewal is not paid, the workspace is paused after a grace period until payment is made. Billing questions: billing@quiksync.com.

6. Availability and changes

We work to keep Send available and secure, but it is provided without a guaranteed uptime. We may change or improve features; we will give reasonable notice of changes that materially reduce the service you have paid for.

7. Suspension and termination

You may cancel at any time; your subscription ends at the close of the paid period. We may suspend or terminate access for material breach of these terms, non-payment, or where required by law. After a subscription ends we keep your data for 90 days so you can resubscribe or ask for an export, then delete it, except where we must keep records (such as invoices) by law.

8. Warranties and liability

Except as expressly stated, Send is provided “as is”. To the extent permitted by law, neither party is liable for indirect or consequential losses, and our total liability arising from Send in any twelve months is limited to the fees you paid for Send in that period. Nothing limits liability that cannot be limited by law.

9. General

These terms are governed by the laws of India, and the courts of Pune, Maharashtra have jurisdiction, without affecting any mandatory consumer or data-protection rights you have where you are. We may update these terms; material changes will be notified by email or in the product at least 30 days in advance.
